This Privacy Policy provides information on how the personal data of users of the website www.electromobilitypoland.pl (hereinafter referred to as the “Website”) is protected.
The content of the Website is the property of the Data Controller – ElectroMobility Poland S.A. with its registered office in Warsaw, Al. Jerozolimskie 81, and is protected by law.
The Website is for informational purposes only. We make every effort to ensure that the content of the Website is as up-to-date as possible.
The Website can be accessed using the most popular web browsers – Chrome, FireFox, Opera, Safari, and others.
The website does not contain any content that violates the rights of third parties or applicable law. In particular, the website does not contain content that causes or poses a threat to the privacy or security of any person, contains information promoting illegal activities or behavior that is offensive, threatening, obscene, defamatory or libelous, inciting racism, persecution on ethnic, cultural or religious grounds, promoting or encouraging criminal activities, violating the rights of third parties, including intellectual property rights, or constituting any other form of infringement of legally protected rights.


Data collection

In accordance with the practice adopted by most websites, ElectroMobility Poland S.A. stores HTTP queries directed to our server. The resources viewed are identified by their URL addresses. The exact list of information stored in the web server log files is as follows:
public IP address of the computer from which the request came (this may be the user’s
computer)
client station name – identification performed by the HTTP protocol, if possible,
user name provided during the authorization process,
time of the request,
first line of the HTTP request,
HTTP response code,
number of bytes sent by the server,
URL of the page previously visited by the user (referrer link) – if the transition to our website was made via a link,
information about the user’s browser,
information about errors that occurred during the execution of the HTTP transaction.
This data is not associated with specific individuals browsing the Website. In order to ensure the highest quality of service, we occasionally analyze log files for purposes such as determining which pages of the Website are visited most often, which web browsers are used, and whether the structure of the website contains errors.

Additionally, we would like to inform you that data is collected through our website using tools provided by Google Analytics. Google Analytics collects its own cookies, independently of ElectroMobility Poland S.A.

Pixel mechanism

Through social media plugins, Facebook, LinkedIn, and Twitter, these websites record activities taking place on our Website. These events are predefined by these websites and enable them to monitor conversions, optimize their activities, and create audience groups (e.g., people interested in electromobility). We receive such data, but it is not user data, only information about the number of people who visited our Website via social media. The information collected is not personal data.


Responsibility

This Privacy Policy does not cover any information relating to services or goods provided by entities other than ElectroMobility Poland S.A.
We are not responsible for the actions or omissions of users of the Website.
We reserve the right to introduce changes, withdraw or modify the functions or properties of the Website, as well as to cease operations, transfer rights to the Website and take any legal action permitted by applicable law. Our actions may not violate the rights of the user.


Personal data processing policy

1. The administrator of data provided via the website www.electromobility.pl and other communication channels, including in particular e-mail, is ElectroMobility Poland SA with its registered office in Warsaw at Al. Jerozolimskie 81.

Personal data provided via the website will be processed on the basis of our legitimate interest in maintaining contact with visitors to our website in accordance with Article 6(1)(f) of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, “GDPR.”. In this case, personal data will be processed in order to respond to the question sent and to take steps to establish cooperation.
4. If you contact the Administrator via e-mail, the address of which is provided in the Contact tab on the Website or in the contact form, your personal data will be processed for the period necessary to respond to your inquiry or request and archived for the period necessary to process your inquiry or request. After this period, personal data will be deleted, unless their processing is necessary for the performance of cooperation, in which case the data will be processed until the contract is performed, for the period specified by tax and accounting regulations, and in the case of claims arising from the contract, until their expiry.

If you contact the Administrator via the e-mail addresses of the Administrator’s employees or representatives, your personal data will be processed on the basis of Article 6(1)(f) of the GDPR for the purpose of contacting you. The data will be processed for the period necessary to respond to your inquiry. If the contact is made in connection with a contract concluded with the entity you represent, the data may also be processed for the purpose of cooperation, pursuing claims, defending against such claims, as well as for the purpose of fulfilling the legal obligation incumbent on the Administrator, which may include the execution of invoices, keeping accounting books and tax documentation (Article 6(1)(c) of the GDPR). In this case, the data will be processed until the contract is performed, for the period specified by tax and accounting regulations, and in the case of pursuing claims under the contract, until they become time-barred.
6. The personal data obtained will be transferred to processors who provide services to ElectroMobility Poland S.A., including entities cooperating with ElectroMobility Poland, e.g. in the field of IT services.
7. As a rule, your personal data will not be transferred outside the European Economic Area (hereinafter: EEA). However, considering the services provided by the Administrator’s subcontractors in the provision of support for ICT services and IT infrastructure, the Administrator may commission specific IT activities or tasks to recognized subcontractors operating outside the EEA. This may result in the transfer of your data outside the EEA. Individual countries outside the EEA in which your personal data will be processed, in accordance with the decision of the European Commission, ensure an adequate level of data protection (in line with EEA standards). However, in the case of processing in countries where the European Commission has not found an adequate level of protection, the Administrator concludes appropriate agreements with the recipients of your personal data in order to ensure such protection. These agreements are based on standard contractual clauses issued by the European Commission in accordance with Article 46(2)(c) of the GDPR. A copy of the standard contractual clauses can be obtained from the Controller. The method used by ElectroMobility Poland S.A. to secure your data complies with the principles set out in Chapter V of the GDPR. In connection with the above, you may request further information about the security measures used in this regard, obtain a copy of these measures, and information about where they are available.
8. In connection with the processing of your personal data, you have the right:
a. to request the Administrator to provide access to your personal data and the right to rectify, delete or limit the processing of your personal data, as well as the right to transfer your data;
b. to lodge a complaint with the Personal Data Protection Office if you believe that the processing of your personal data violates the provisions on personal data protection;
c. object to the processing of personal data – you have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you based on Article 6(1)(f). The controller shall no longer process such personal data unless he demonstrates that there are legitimate grounds for the processing which override your interests, rights and freedoms or for the establishment, exercise or defense of legal claims.
9. Providing personal data is voluntary, but necessary to respond to your inquiry or request. The data subject is required to provide an email address or telephone number, and failure to provide such data will result in the inability to respond to your inquiry or request.
